West Ham were leading 2-1 at the time of the incident but just eight minutes later Gayle equalised for Palace and after the game Hammers co-chairman David Gold confirmed the club would lodge an appeal against the red card.
"An Independent Regulatory Commission has today (Tuesday 5 April 2016) upheld a wrongful dismissal claim in relation to West Ham United’s Cheikhou Kouyate," a statement from the FA read.
"The player, who was dismissed for serious foul play during the game against Crystal Palace on Saturday (2 April 2016), will therefore not serve any suspension."
